1009.1 PURPOSE AND SCOPE
This policy establishes limitations on smoking and the use of tobacco products by members and others while on-duty or while in Lincoln Police Department facilities or vehicles.
For the purpose of this policy, smoking and tobacco use includes, but is not limited to, any tobacco product, such as cigarettes, cigars, pipe tobacco, snuff, tobacco pouches and chewing tobacco, as well as any device that is intended to simulate smoking, such as an electronic cigarette or personal vaporizer.
1009.2 POLICY
The Lincoln Police Department recognizes that tobacco use is a health risk and can be offensive to others. All forms of tobacco use also present an unprofessional image for the Department and its members. Therefore all forms of tobacco use are prohibited by members and visitors in all department facilities, buildings and vehicles, and as is further outlined in this policy.
1009.3 SMOKING AND TOBACCO USE
Smoking and tobacco use by members are prohibited any time members are in public view representing the Lincoln Police Department.
It shall be the responsibility of each member to ensure that no person under his/her supervision smokes or uses any tobacco product inside City facilities and vehicles.
1009.4 ADDITIONAL PROHIBITIONS
The Lincoln Police Department may designate smoking areas that meet the statutory requirements of Ala. Code § 22-15A-5 and Ala. Code § 22-15A-6.
1009.5 NOTIFICATION TO EMPLOYEES
Policy and statutory prohibitions related to smoking shall be communicated to any existing or prospective employees upon request (Ala. Code § 22-15A-5).
These policies and operating procedures are not designed to cover every possible scenario or situation in society, but rather to define standard operating procedures for members of the Lincoln Police Department. These guidelines are subject to past, present and future judicial review. These guidelines can be amended and or repealed by the Chief of Police as necessary. The policies and procedures herein provided supersede all previous policies and orders.
