900.1 PURPOSE AND SCOPE
The City of Lineville contracts with the Clay County Sheriff's Office for jail services. The purpose of the County Jail is to house individuals arrested for violation of federal, state, county and local laws. Employees of the Lineville Police Department are excepted to honor the operational guidelines as established by the Clay County Sheriff's Office.
900.2.2 WEAPONS IN JAIL
(a) All prisoners shall be searched by arresting officers prior to submitting them to jail.
(b) All law enforcement officers of the Lineville Police Department, and any other agency, will remove their weapons prior to entering the County Jail. Weapons removed by law enforcement personnel will be stored and secured in an appropriate place prior to entry.
900.2.3 HOLDS
No holds shall be accepted on any prisoner housed in the Clay County Metro Jail unless the hold has been authorized by a specific law enforcement officer. The requesting officer's name, law enforcement agency, and if possible, the case number is to be logged by the officer on duty at the time of request. If a hold is placed on a prisoner by another law enforcement agency, a copy of the teletype, if applicable, should accompany the request.
900.4.14 CONDITIONAL BOND FORFEITURES
(a) Contempt of Court
In order for a bail bondsman to return a defendant to jail on a conditional bond forfeiture, the bondsman must provide to the arresting officer a certified copy of the bond and a conditional bond forfeiture. The police officer shall obtain the Contempt of Court warrant, arrest the defendant, prepare an arrest report, attach all the forms together, and route them to the Municipal Court.
(b) Withdrawn Bail – Misdemeanor
In order for a bail bondsman to withdraw bail posted for a client and have him readmitted to jail he must present a certified copy of the bond to the Shift Supervisor and present the prisoner for confinement at that time.
(c) Withdrawn Bail – Felony
Prior to preliminary hearings, a bondsman may seek re-commitment of a client to jail and release from the posting of the bond. They shall present a certified copy of the bond to the Shift Supervisor and present the defendant at that time.
After preliminary hearings, a bondsman must submit the certified copy of the bond and the client to the County Sheriff
(a) NOTE: Alabama law does not allow usage of this law for debt collection by a bonding company.
900.4.17 PRISONERS' PROPERTY
The arresting officer and/or Correctional Officer shall properly record on the jail envelope of any person arrested the exact amount of all personal property, including money, that is taken from him/her at the time of arrest or booking, as well as to document any damage to personal property at the time of receipt.
The Shift Supervisor or Corrections Officer shall release to the proper person, without unnecessary delay, all property, including money, at the time of the prisoners' departure from the facility. This, however, would not include any items having been sized as evidence for judicial proceeding purposes.
900.5.3 RETURN OF PERSONAL PROPERTY
All personal property shall be returned to prisoners and signed for by them at the time of release.
These policies and operating procedures are not designed to cover every possible scenario or situation in society, but rather to define standard operating procedures for members of the Police Department. These guidelines are subject to past, present and future judicial review. These guidelines can be amended and or repealed by the Chief of Police as necessary. The policies and procedures herein provided supersede all previous policies and orders.
